OWNERSHIP: The Licensor ("INFORNERIS - SOLUÇÕES INFORMÁTICAS LDA") shall licence this Mobile Application (the "Licensed Application"), named "IgrejaBraga", to you (the "End User"), only on the condition that you accept all the terms contained in this Licence Agreement.
PRIVACY NOTICE/PRIVACY POLICY: The use of the Licensed Application does not imply nor exclude any sort of collection of Personally Identifiable Information, as defined and protected by privacy laws; the Licensed Application may collect or import Personally Identifiable Information from the users’ devices and it may use the device capabilities to provide and enhance the overall experience of the application.
DATA COLLECTION: Non-personal identifiable information may be collected and transmitted, with or without the End User consent, for the purpose of analysing overall usage and performance of the Mobile Application. The types of non-personal identifiable information the Licensed Application may collect and use include but are not limited to: (i) mobile device type and properties; (ii) mobile device software platform, firmware and capabilities; (iii) mobile phone carrier; and (iv) other non-personal data required by the Licenced Application to enhance its services. The Licensed Application may use third party analytics service providers to understand anonymous aggregated usage data for the Licensed Application. The Licensed Application and its Licensor are not liable for the actions of those third parties.
PROPRIETARY RIGHTS; RESTRICTIONS: You acknowledge that the Licensor retains all right, title and interest in the original and any copies of the Licensed Application. Without limiting the foregoing, you agree not to: (a) use the Licensed Application for commercial or for non-individual use; (b) copy, reproduce, distribute, repackage, distribute or in any other manner duplicate the software, in whole or in part; sell, lease, license, sublicense, distribute, assign, transfer or otherwise grant any rights in the software, in whole or in part; (f) modify, port, translate, or create derivative works of the software; (g) decompile, disassemble, reverse engineer or otherwise attempt to derive, reconstruct, engineer or otherwise attempt to derive, reconstruct, identify or discover any source code, underlying ideas, or algorithms, of the software by any means and (h) remove any proprietary notices, labels, licences or marks from the software. You may be held liable for any copyright infringement that results from such unauthorized uses of the Licensed Application.
INFORMATION SUBMITTED TO LICENSED APPLICATION: Any and all information the End User provides to or is automatically collected by the Licensed Application may be disclosed if so required to meet legal or regulatory requirements, such as under a court order or to a government institution if required or authorized by law, or in the event of a sale, merger or acquisition to another entity.
ACCESS TO DEVICE: The Licensed Application will have access to your device, with the End Users’ consent, expressed by End Users’ installation and use of the Licensed Application. The Licensed Application, features or parts of it, may not function correctly without the End Users’ consent to the device capabilities, such as, but not limited to: Camera, Network access; View network information; Access to storage; Modify or delete the contents of internal or external media devices; Access location services.
LICENSED APPLICATION DEPLOYMENT AND UPDATES SOURCES: The Licensed Application will be available through: (i) Google Play Store; (ii) Apple Store; (iii) Windows Store for Windows Phone; (iv) Licensor website.
DATA LOSS: The Licensed Application tries its best to provide services at a commercially reasonable level. We work hard to meet users’ needs and assure the consistency and security of our services. However, we might fail to foresee some legal and technological risks including but not limited to service interruption, data loss and other damages or risks due to force majeure, viruses, Trojans, hackers´ attack, unstable systems, defective services provided by third parties, or government actions. You hereby acknowledge and confirm that you use the Licensed Application at your own risk.
LICENSE GRANT: In consideration of your compliance with this License Agreement, the Licensor grants you non-exclusive, non-transferable right and license to use this software as incorporated in the Licensed Application for the sole and limited purpose of accessing its available features, as permitted by the Terms of Service set forth in either one of the sources specified in point 7 of the License Agreement, from where the End User sourced its deployment and updates.
COPYRIGHTS AND TRADEMARKS: The trademarks, names, logos and service marks (collectively "trademarks") displayed or mentioned on the Licensed Application, relevant websites and in this License Agreement, are registered and unregistered trademarks of their respective owners.
TERMINATION: This License Agreement will automatically terminate if you fail to comply with any of its terms.
DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY: Neither the License Application nor its Licensor warrant that the software will meet your requirements or that the operation of the Licensed Application will be uninterrupted nor error free. THE LICENSED APPLICATION IS PROVIDED ON AN `AS IS´ BASIS AND THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE LICENSED APPLICATION, ITS LICENSOR, ITS DEALERS, DISTRIBUTORS, AGENTS, OR EMPLOYESS SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS LIMITED WARRANTY. THE DURATION OF ANY IMPLED WARRANTY SHALL BE LIMITED TO THE DURATION OF THE LIMITED WARRANTIES SET FORTH HEREIN. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE LICENSED APPLICATION AND/OR ITS LICENSOR BY LIABLE TO YOU OR ANY PERSONS FOR LOSS OF BUISINESS OR PROFITS; OR FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE THE LICENSED APPLICATION.
GOVERNING LAW: This License Agreement, including the warranty Disclaimer and Limitation of Liability, are governed by the laws of Portugal and the district of Braga.
